CBS 12 Greatest American Dog Contest Rules June 30, 2008- August 4, 2008 1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS SUBJECT TO ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS, ORDINANCES AND REGULATIONS. VOID WHERE PROHIBITED OR RESTRICTED. 2. ELIGIBILITY: The Sweepstakes is open to residents of Palm Beach, Martin, St. Lucie, Indian River and Okeechobee counties, Florida, who are 18 years of age or older as of June 30 , 2008. Current and former full-time or part-time employees of WPEC/Freedom Broadcasting of Florida, Inc., their affiliates, their advertising agencies and promotional companies involved in this promotion, their agents, families, successors and assignees, and current employees of all radio, television or cable TV facilities in the West Palm Beach television DMA and their immediate families residing in the same household, are not eligible to participate. Definition of immediate family members to include husband, wife, mother, father, brother, sister, and grandparents, or as defined and deemed appropriate solely by WPEC. 3. CONTEST PERIOD: The contest begins on Monday, June 30, 2008 and concludes on Monday, August 4, 2008. Contestants upload a photo of their dog to the cbs12.com website starting at 12 midnight June 30, 2008, and in 120 words or less, tell why their dog is the greatest. Beginning July 10, 2008, people can vote for their favorite dog. There will be four weekly winners and the winners with the most votes by 12 midnight July 14, July 21, July 28 and August 4th, will win. Contestants can enter their dog each week, but can only win once during the contest period. 4. NAME OF WINNERS: The names and faces of all finalists and winners might be posted on WPEC’s Web site. Names and faces may be used in any on-air promotion to promote the contest for up to one year. 5. SPONSOR: By participating in this contest, contestants agree to be bound by these Official Rules and by all decisions of the Sponsor, WPEC. All decisions of WPEC relating to the administration of this Sweepstakes, including, without limitation, decisions relating to the eligibility of contestants, the award of the prizes, and the interpretation of these Official Rules, shall be final and binding in all respects. WPEC will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Sweepstakes materials. WPEC reserves the right in its sole discretion to suspend, modify or terminate this Sweepstakes if necessary to comply with any federal, state or local law, ordinance or regulation, or if WPEC determines in its sole discretion that the integrity of the Sweepstakes has been compromised by fraud, tampering, unauthorized human intervention or other causes beyond the reasonable control of WPEC which threaten to corrupt or impair the administration, security, fairness or proper operation of the Sweepstakes. 6. LIMITATIONS OF LIABILITY: By participating in the contest, contestants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased, and any other damages, other than damages for actual out-of-pocket expenses. 7. CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision. In the event any such provision is determined to be invalid or unenforceable, the balance of these rules shall remain in full force and effect as if the invalid or unenforceable provision was not contained herein. 8. GENERAL RELEASE: By participating in the contest, contestants release WPEC/Freedom Broadcasting of Florida, Inc., any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the contest (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). 9. CLAIMING PRIZES: Each weekly winner will win a $50.00 gift certificate from Pet Supermarket and a 5 by 7 customized watercolor of their canine from HutchinsonCreations.com. Winners may not substitute prizes and there is no cash substitute for prizes. If weekly winner does not wish to claim their prize, or does not respond to CBS 12’s efforts to contact them via email or phone within 48 hours, the prize then goes to next contestant with the most votes that week. Winners have the option of picking up their prize in person at WPEC-TV, 1100 Fairfield Drive, West Palm Beach, Florida 33407. Or, winners can have their prizes mailed to them. WPEC-TV takes no responsibility for these prizes if they should get lost or misplaced in the mail.
